RENTAL TERMS & CONDITIONS
Advance Payment Required Reservations
At the time of booking a credit card advance payment will be required equivalent to fifteen percent (15%) of the total due to include a non-refundable reservations fee (see "Reservations Fee" below). Optional travel insurance, which protects you from unexpected events such as hurricanes (see "Vacation Insurance Protection" below) is available for a fee of 6.5% of the reservation total, and if taken is also due at the time of booking. Reservations for condominiums made less than 30 days prior to arrival require payment in full immediately. All advance payments will be held in an interest bearing account with all interest going to the management company.
Reservation Fee
There will be a $25.00 reservation fee per unit booked. The reservation fee is automatically added to the reservation and will appear as a separate line item in the guest folio.
Cancellation Policy
Cancellation before final payment (30 days prior to arrival) will result in a loss equal to 15% of the total amount due plus the non-refundable reservation fee and travel insurance if purchased. (NOTE: Guest covered under Travel Guard rental vacation insurance are exempt from the 15% early-cancellation fee if the reason for cancellation is a covered reason under the travel insurance.) Cancellation after final payment will result in a 100% loss of the total cost of the stay. The 100% cancellation loss can be avoided if: (1) Travel Guard rental vacation insurance was purchased; or (2) Brooks and Shorey Resorts can re-rent the unit for the full term of the original rental period, in which case the guest will be charged a 10% rebooking fee in addition to the reservations fee. Prior to arrival, if a guest has to shorten their stay or change their unit, normal cancellation penalties may apply, whether they are insured or not. Refunds issued by Brooks and Shorey Resorts will be issued no more than 30 days after departure date of original stay. Refunds are payable to the guest within 30 days after the subsequent re-rent payment has cleared our account. Full Payment Due
If you are renting a condominium, your remaining balance is due 30 days prior to your check-in date. IF WE HAVE NOT RECEIVED A CHECK OR MONEY ORDER 30 DAYS PRIOR TO YOUR CHECK-IN DATE, YOUR CREDIT CARD WILL BE CHARGED AUTOMATICALLY. This balance includes the remaining eight-five percent (85%) of the listed rental rate and all taxes. All taxes are subject to change. Final payment is non-refundable upon cancellation unless the stay is rebooked (see "Cancellations" above). The guest is responsible for payment, deposits, and other responsibilities detailed in the confirmation correspondence.
Age Requirements
The individual making the reservation must be 25 years of age or older and must occupy the rental property the entire term of the reservation.
Family Rental Only
Reservations made for teenagers or young single groups will not be honored without an accompanying adult couple staying in the unit at ALL times. We require at least one member of the party to be 25 (twenty-five) years of age! Any violators will be evicted according to Florida Statute 509-141 with forfeiture of all monies.
Falsified Reservation
Any Reservation obtained under false pretense will be subject to forfeiture of reservation deposit, damage deposit, and/or balance of rental payment. Guest will not be permitted to check in.
Check-In Time
Check-in time is after 4:00 p.m.; checkout time is 10:00 a.m. Due to our high standards for cleanliness, not all units will be ready for check-in promptly at 4:00 p.m. We ask for your patience and suggest that you have alternate plans available between 4:00 p.m. and 6:00 p.m. in case the unit is not yet ready.
Damage Deposit
All guests are required to select one of the two following options:
- A credit card authorization in the amount of $300.00 is required as a damage deposit. This amount is reserved on your credit card and is dropped within 10 business days. In the event damage or loss occurs in your rented condo we will charge your card for the actual amount of ALL charges incurred, whether more or less than $300.00. OR
- Security Deposit Protection covers the cost of accidental damages to your rented condo. In lieu of tying up $300.00 on your credit card, we encourage you to take advantage of our damage waiver program. The damage waiver only costs $39.00 and covers up to $3,000.00 of damage.
Please note any damage to the property upon your arrival and report it immediately to your rental manager to avoid possible liability. Please, notify us immediately if any loss or damage occurs during your stay.
Unit Assignments
We reserve the right to change unit assignments. We try to accommodate your request; however, a specific unit cannot be guaranteed.
Occupancy
The maximum number of guests per apartment is limited at most properties to four (4) persons in an efficiency or studio, six (6) persons in a one bedroom, six (6) persons in a two bedroom and eight (8) persons in a three bedroom. Other restrictions may apply.
Monthly Reservations
Three (3) month rentals or longer will be given priority during the winter season. AMENITY PACKAGES ARE NOT AVAILABLE FOR 30 DAY OR LONGER RENTALS. Credit card payments will not be accepted for monthly reservations.
Absolutely No Pets Are Allowed
If evidence of a pet(s) is found in your unit or on the premises, you will be evicted immediately with no refund of rent or damage deposit.
No Daily Maid Service
Housekeeping fee includes departure clean only. Linens and bath towels are included and not to be taken from the unit. An initial setup of trash liners, bathroom paper, and facial soap is provided. Extra items needed are the responsibility of the guest. Beach towels are to be provided by the guest.
Utilities
No compensation will be given for temporary outage of pool, electricity, elevator, gas, water, cable or telephone service. Outages will be reported immediately and all efforts will be made to have them restored as soon as possible. The operation and maintenance of these utilities is out of the control of Brooks and Shorey Resorts, Inc.
Rules and Regulations
All Guests, as well as Owners, are required to conform to all rules and regulations which are provided for each property. Guests are subject to eviction, according to Florida Statue 509.141 with all loss monies.
Non-Smoking Units
Smoking is strictly prohibited inside "non-smoking" rental units. Your damage deposit will be forfeited and you will incur an additional charge for carpet cleaning and deodorizing if any evidence of smoking is found in a non-smoking unit.
Keys
Any after-hours service calls for lost keys or for locked-out guest will require a $30.00 charge.
Agency Disclosure
Brooks and Shorey Resorts, Inc. is the agent of the property owner and is acting at all times, in and for the best interest of the owners. Agent will not be held responsible for acts of theft or vandalism or for damages to the guest´s property or items left in the unit.
